License Agreement for Game Plumbing Framework

THIS LICENSE AGREEMENT (THE AGREEMENT) APPLIES TO LAUNCH IT LABS INC's PRODUCTS AND SERVICES DELIVERED UNDER THE GAME PLUMBING FRAMEWORK , (HENCEFORTH REFERRED TO AS "THE SOFTWARE"). ANYONE LICENSING, ACCESSING, OR USING THE SOFTWAREA IS SUBJECT TO THIS AGREEMENT.

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE LICENSING, ACCESSING OR USING GAME PLUMBING FRAMEWORK. BY COMPLETING THE ONLINE REGISTRATION FORM, ACCESSING OR USING GAME PLUMBING FRAMEWORK, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT AND YOU REPRESENT THAT YOU HAVE AUTHORITY TO BIND YOUR COMPANY AND/OR OTHER ENTITY(IES) (COLLECTIVELY, THE CUSTOMER OR YOU) TO THIS AGREEMENT.

LAUNCH IT LABS INC, (HENCEFORTH REFERRED TO AS "THE COMPANY"), MAY REVISE AND UPDATE THIS AGREEMENT AT ANY TIME WITHOUT NOTICE BY POSTING THE AMENDED TERMS TO https://docs.gameplumbers.com/license. YOUR CONTINUED USE OF THE SOFTWARE MEANS THAT YOU ACCEPT AND AGREE TO THE REVISED AGREEMENT.

GENERAL

The software, documentation and any fonts accompanying this License whether on disk, in read only memory, on any other media or in any other form (collectively the "Software") are licensed, not sold, to you by THE COMPANY for use only under the terms of this License, and THE COMPANY reserves all rights not expressly granted to you. The rights granted herein are limited to THE COMPANY's intellectual property rights in the Software and do not include any other patents or intellectual property rights. By registering for a key, you are granted a license to use the software, however THE COMPANY retains ownership of the Software itself. Your license only grants use of the software for your own commercial applications used by non-technical end users. You are not permitted to redistribute the Software or include it as part as a part of a tool.

NO WARRANTIES

You are solely responsible for all AWS charges accrued from your use of this software. The authors of THE SOFTWARE do not guarantee the AWS costs associated with it. Although we have observed negligible costs for our own testing environment, it is theoretically possible to create ServerObjects ("SO") that message each other recursively, and it's theoretically possible that they unleash limitless load. Make sure you don't inadvertently create SOs that message each other in a never-ending loop.

This software is offered on a limited, revocable, non-exclusive, non-transferable basis, and provided "AS IS." THE AUTHORS OF THIS SOFTWARE MAKE NO WARRANTIES AND DISCLAIM ALL WARRANTIES, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE AND SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DESIGN, TITLE, AND NON-INFRINGEMENT. By using this software, you agree not to attempt to reverse engineer this software or to publish any product with this software not authorized by the authors of this software.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. EXCEPT FOR THE LIMITED WARRANTY ON MEDIA SET FORTH ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND DANGER AND DANGER'S LICENSORS (COLLECTIVELY REFERRED TO AS "DANGER" FOR THE PURPOSES OF SECTIONS 6 AND 7) HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. DANGER DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SOFTWARE, THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY DANGER SHALL CREATE A WARRANTY. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

LIMITATIONS OF LIABILITY

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL DANGER BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF DANGER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall THE COMPANY's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars (\$50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

PRIVACY AND SECURITY Each party will be responsible for its own compliance with all applicable data protection/privacy laws and regulations.

DATA COLLECTION

The Company collects your usage data on THE SOFTWARE. By using THE SOFTWARE you, consent to your usage data being collected for internal purposes. Such usage data subject to collection may include: If you do not wish for your usage data to be collected, you should not use the THE SOFTWARE.

RULES OF CONDUCT

You agree that you will not transmit, distribute, post, store, link, or otherwise, traffic in information, software, or materials on or through the THE SOFTWARE that (i) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, offensive, profane, contains or depicts pornography that is unlawful, or is otherwise inappropriate as determined by us in our sole discretion, (ii) you know is false, misleading, untruthful or inaccurate, (iii) constitutes unauthorized or unsolicited advertising, (iv) impersonates any person or entity, including any of our employees or representatives, or (v) includes anyone's identification documents or sensitive financial information.

You shall not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the THE SOFTWARE (including without limitation any application), except to the limited extent applicable laws specifically prohibit such restriction, (ii) modify, translate, or otherwise create derivative works of any part of THE SOFTWARE, or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws, and regulations.

TERMINATION

This License is effective until terminated. Your rights under this License will terminate automatically without notice from THE COMPANY if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.

INDEMNIFICATION You agree to indemnify and hold The Company harmless for any claims arising out of your use of THE SOFTWARE.
